Comprehensive terms covering our Digital Services, Real Estate, and Events.
1. Acceptance of Terms
By accessing or using Shipping Smile services (Digital Solutions, Real Estate, or Events), you agree to be bound by these Terms. If you disagree with any part, please discontinue use immediately.
Your continued use of the platform following changes constitutes acceptance of the new Terms.
2. Payments & Billing
- Digital Services: A 50% deposit is required to start projects. The remaining 50% is due upon completion before final file transfer.
- Events: Tickets must be paid in full at booking. No refunds within 48 hours of the event date.
- Real Estate: Agency commissions apply as per local regulations upon successful rental or sale contracts.
Late payments incur a 5% fee per month. Prices are exclusive of applicable taxes.
3. Service-Specific Rules
Specific obligations vary by sector:
- Digital Services: Scope of work must be defined in writing. "Scope creep" (adding features outside the initial agreement) will incur extra charges.
- Real Estate: Property details are provided in good faith; we do not guarantee availability without prior reservation.
- Events: Attendees must adhere to venue rules and security checks. IDs may be required for age-restricted events.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use.
You must be at least 18 years old to create an account or use our real estate/digital services.
5. Limitation of Liability
To the fullest extent permitted by law, Shipping Smile shall not be liable for:
- Indirect, incidental, or consequential damages.
- Loss of profits, data, or business opportunities.
- Digital: Delays caused by third-party APIs or client feedback cycles.
- Events: Cancellations caused by venue management or government mandates.
Our total liability is limited to the amount paid for the specific service.
6. Intellectual Property
All content (logos, designs, text, property photos) on this platform is owned by Shipping Smile or its licensors.
For Digital Clients: You own the final deliverables (code/designs) upon full payment. We retain the right to showcase the work in our portfolio.
7. Indemnification
You agree to indemnify and hold harmless Shipping Smile, its officers, and employees from any claims, damages, or expenses arising from:
- Your use of the services.
- Your violation of these terms.
- Violation of any third-party rights.
8. Governing Law
These Terms shall be governed by the laws of the jurisdiction in which Shipping Smile is registered. Any disputes shall be resolved in the courts of that jurisdiction.
